Negligence lawsuit filed against John’s Island Daycare

September 7, 2016 By admin

A Negligence lawsuit was filed against a John’s Island Daycare.  Live Oak Little School on River Road, a local day care is facing a negligence lawsuit for leaving the kids unsupervised.

The incident involves a toddler having been left unsupervised and left to roam around the schoolyard by herself which resulted in a snakebite by a venomous snake on the sidewalk. The teacher failed to inspect the play area, which is required by the employee handbook.  Surgery was ultimately required.

There were other incidents that followed which involve the child being physically harmed as a result of the school and teachers’ failure to enforce its own rules and maintain a safe environment for the children.  The injuries are significant but fortunately, not life threatening.

Attorney Matthew Pecoy of McGrath Law Firm recently filed the lawsuit against the daycare.  Unfortunately, this case is part of a national trend where it appears that children are left unsupervised while attending daycare.  In its article on this matter, The Post and Courier  has attempted to obtain the number of times the Out-of-Home Abuse and Neglect Investigations Unit investigated abuse and neglect complaints were filed at the day care since 2012 at DSS but was unsuccessful in obtaining an answer.

McGrath Law Firm of Mount Pleasant, South Carolina has filed many personal injury cases for injuries to children and recently won a jury trial in Charleston, South Carolina for a personal injury client.
